Process – Step by Step Procedure
This section outlines the way we provide our service, and the standard procedure our clients can expect us to follow.
We prepare applications for Tier 1 and Tier 2 of the Points Based System, and other applications for various forms of leave to enter/remain, as well as naturalisation. We also prepare applications for skilled visa categories for many other countries around the world. In each case we can be instructed by (and paid by) either an individual, an employer, or separate body such as a recruitment agency. In each situation, the way in which we provide our service remains consistent.
Initially, and with no obligation, we will normally begin by performing a free assessment, and providing free advice based on individual circumstances. We then continue to provide assistance and advice (depending on general viability and circumstances) until we get to the stage where we are confident that we could submit a successful application. If we believe that the application should be successful, we will offer to take responsibility for the process of preparing it and, where appropriate, presenting it to the relevant government department on behalf of the client. At this point we will ask the client to sign our terms and conditions, which confirm any guarantee of success (if relevant), and also lay out the responsibilities for us, and for the client.
We provide advice on:
- Skills thresholds and other requirements of each scheme
- Timescales
- Advertising requirements
- Immigration requirements and restrictions
- Candidate or applicant supporting documentation and certification
- Employer or business-related documentation
- Employer compliance requirements and issues
We then prepare the relevant application form, making entries on the form itself in line with all other supporting documents which are then collated and submitted with the application. In the course of preparing the application form, we will provide guidance, help and feedback to the client relating to the relevant supporting documentation. We act as the official representative and deal directly with the relevant government department on behalf of the client, employer or applicant as appropriate. We will always try to strike a perfect balance by being thorough enough to ensure the success of each application, but not asking the client for lots of unnecessary additional documentation or detail. The applicant or the employer will always ultimately need to sign an application form. Beyond signing the application form and providing the minimum required amount of documentation for a safe application, we aim to minimise the amount of time our clients need to invest.
We are often able to offer a refund guarantee in the case of individual applications, demonstrating our commitment to a positive outcome for each application. Our standard terms for non sponsor driven applications normally include a commitment that in the event of an application being refused, we promise to refund 110% of our fee. Once a client has signed our terms and conditions document and we have opened a file, we invoice for immediate payment of our fees and all relevant government Visa fees. Alternative payment terms can be arranged with employers who sign a Service Level Agreement. Any conditions, on which our guarantee might rest, are always declared in writing with or before the arrival of our terms and conditions document, (or for SLA clients before or when we open a file). Our standard terms and conditions explain clearly our responsibilities, and the client’s responsibilities. If a refund of fees is due in any case according to our terms and conditions, then the refund is provided promptly and without delay.
