Permanent residence for European nationals and their family members
Individuals who are currently in the UK on the basis of their EEA nationality or the EEA nationality of a family member can normally qualify for Permanent Residence after completing five years of residence in the UK in this category.
“Permanent Residence” is essentially the same as Indefinite Leave to Remain once granted but is only available to individuals relying on rights of residence under European law. Points to note are:
- EEA citizens and their family members pay a nominal fee for the application.
- Permanent Residence applications can take up to 6 months to decide.
- It is not currently possible for EEA citizens and their family members to apply for Permanent Residence using a same – day service through a Premium Centre appointment. These applications need to be made by post.
Individuals submitting these applications themselves risk waiting for up to six months whilst the UKVI are deciding the application, only for it to be refused due to a relatively minor problem. It is therefore important to get the application right the first time, especially if the applicant or their family members need to travel outside of the UK.
