The British Government, via the UK Border Agency, has announced that the Tier 1 (Post-Study Work) category is to be closed from April 2012. The function of this category will be partially replaced with an expansion of the Tier 2 (General) scheme. Introduction
Tier 1 (Post-Study Work) was introduced on the 30th June 2008, and was based on the established International Graduates Scheme (IGS). Individuals who have graduated, or are due to graduate from a UK university with a Bachelor’s degree, Master’s degree, PhD or a post-graduate certificate or diploma may be able to remain in the UK under the Post Study Work sub-category of Tier 1 of the Points Based System. The Tier 1 (Post-Study Work) category does not require the involvement of any employer to “sponsor” the application – instead the application is completely driven by the individual, who, if successful, will have the right to work freely within the UK for a period of two years.

Aims and purpose
This sub-category is intended to provide a transitional route for graduates from eligible UK institutions to gain work experience in the UK or establish a career here, and then transfer into Tier 2 or other highly skilled (Tier 1) sub-categories.
Criteria
To be granted leave under the scheme applicants must have completed an approved course of study at a recognised or listed UK institution of Higher or Further Education within 1 year of the application being submitted. A relevant course is:
- a Bachelor’s degree course
- a Master’s or PhD course
- a Postgraduate Certificate in Education (PGCE)
- a Professional Graduate Diploma in Education (PGDE)
- an HND qualification at level 8 or above from a recognised Scottish Institution
The UK institution must be either a UK recognised or listed body, or it must appear on the list of sponsors under Tier 4 of the points based system. A list of recognised or listed UK institutions of Higher or Further Education is available on the Department for Education and Skills website at www.dfes.gov.uk/recognisedukdegrees/
In addition, applicants must also be able to show that they have enough funds to maintain both themselves and any dependants.
Necessary Documentation
Applicants need to evidence the points they gain by providing original documents. The Border Agency can be very strict about documentation, and in most situations, will only accept original documents. The typical documents that an applicant would need to submit might include:
- Passport (current and previous);
- Original degree certificates;
- A letter from the applicant’s university;
- Original bank statements.
Period of Stay
Initial applicants who are successful will be granted leave to remain for a period of 2 years. It is only possible to ever hold one grant of leave under a post-study category.
Other Useful Information
An applicant may apply for his/her dependents (husband/wife and dependent children under 18) to be granted leave on the basis of his/her Tier 1 (Post-Study Work) visa.
